1. About these Terms
These Terms and Conditions apply when you use ellevate.fit, create an account, place an order or buy products from ELLEVATE. ELLEVATE is operated by Ellevate by Dripify for Clothing & Shoes.
By using the website or placing an order, you agree to these Terms together with our Privacy Policy, Cookie Policy, Returns and Exchanges Policy, Shipping and Delivery Policy and any other terms shown to you at checkout. If you do not agree, please do not use the website or place an order.
2. Eligibility
You must have the legal capacity to enter into a purchase. If you are under the age of legal capacity where you live, please use the website and place orders only with the involvement and permission of a parent or legal guardian.
3. Your account
You are responsible for giving accurate information and for keeping your login details secure. Please tell us if you believe your account has been used without your permission.
We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, investigate misuse or comply with the law.
4. Product information
We try to show product descriptions, photographs, colors, sizes, prices and availability accurately. Screen settings, lighting and photography can make colors look slightly different, and measurements can vary slightly. A minor visual difference caused by display settings is not a product defect.
Nothing in these Terms limits rights that cannot lawfully be excluded where a product is defective, unsafe, incorrect or does not match the agreed description.
5. Availability
Products are subject to availability. Adding an item to your cart does not reserve it.
If an item becomes unavailable after you order, we will contact you to arrange an appropriate solution. Where payment has already been collected and we cannot supply the item, any amount that must be returned will be handled according to applicable law and the payment method used.
6. Prices
Prices are shown in Israeli new shekels (₪). We may change prices at any time before an order is accepted.
If there is an obvious pricing, technical or description error, we may correct it and contact you before fulfilling the affected order. Promotional prices apply only during the period and under the conditions shown for that promotion.
7. Orders
An order is an offer to buy the products in your cart. We send an order acknowledgement after checkout. An order is accepted when it is confirmed for processing or, for card payments, when payment is successfully verified.
We may refuse or cancel an order where reasonably necessary because of stock problems, suspected fraud, incorrect pricing, payment failure, delivery limitations, misuse of a promotion or another legitimate operational reason. If we cancel an order after collecting payment, any required reversal or refund will be handled according to applicable law and the payment provider process.
8. Order cancellation
Once an order has been placed, it cannot be cancelled, because preparation and fulfilment begin immediately and orders are generally dispatched the same day.
This does not affect the remedies described in sections 15 and 16 for orders that fail, or for products that are wrong, defective or do not conform to what was ordered, or any rights that cannot lawfully be excluded.
9. Payment
The payment methods available at checkout are Cash on Delivery and card payment (Visa or Mastercard). Card payments are processed securely by our payment provider, Lahza.
For card orders, payment must be successfully authorized and verified before the order is treated as paid. For Cash on Delivery orders, the amount shown in the confirmed order is paid to the courier on delivery.
10. Discount codes and store credit
Discount codes can be used at checkout with or without an ELLEVATE account, and only one code can be used per order. Each code is subject to the conditions shown when it is offered, such as a validity period, a minimum order value, eligible products, a limited number of uses or use by a named customer only.
Unless expressly stated otherwise, discounts apply to the price of the products and not to delivery charges, cannot be exchanged for cash and cannot reduce an order below zero.
ELLEVATE store credit issued after an exchange can be used on a future purchase. It does not expire and has no cash value. If an order uses only part of your store credit, the unused value is not lost: contact us and we will issue it again for a future purchase.
If ELLEVATE cancels an order that used a discount code or store credit, we normally make it available to you again, except where the cancellation is because of misuse or fraud.
We may refuse or cancel a discount obtained through error, abuse, duplication or unauthorized use.
11. Rewards and referrals
ELLEVATE Points, referral rewards and review rewards are promotional features that apply only while the relevant program is active and under the rules displayed on the website at the time.
Eligibility, earning rates, redemption limits, review requirements, referral conditions and availability may change. While points earning is paused, purchases, reviews and referrals made during that time do not create new points.
Points cannot be withdrawn, transferred, sold, gifted or converted to cash. Existing valid balances remain subject to the current Rewards rules shown in your account.
12. Shipping and delivery
ELLEVATE generally aims to deliver confirmed orders within 48 hours. Orders are processed every day and are generally prepared or dispatched the same day. We deliver locally only, to the delivery areas offered at checkout.
The 48 hour delivery time is an estimate, not an absolute guarantee. Delays can happen because of courier availability, incorrect customer information, unsuccessful delivery attempts, exceptional demand, weather, road restrictions, security conditions or circumstances outside our reasonable control. 13. Delivery information
You are responsible for giving a complete and accurate delivery address and a phone number on which you can be reached. We are not responsible for delays caused by incomplete or incorrect information. If a delivery cannot be completed because the recipient is unavailable or unreachable, a new delivery arrangement and additional delivery charges may apply.
14. Returns, refunds and exchanges
Except where applicable law requires otherwise, all sales are final. ELLEVATE does not accept returns or give refunds for change of mind, fit, size or color preference, ordering mistakes or any other reason that is not a defect.
Ordinary exchanges are possible under our Returns and Exchanges Policy: the request must be made within 48 hours of receiving the order, the item must be unused and in its original condition and passes our inspection, the replacement must come from the same collection, and the customer pays the delivery cost of the exchange. If the replacement costs more, the customer pays the difference. If it costs less, the difference is given as ELLEVATE store credit and not as cash.
Items are inspected. An item is not eligible for an ordinary exchange if it shows any sign of wear, washing, use, sweat, deodorant, perfume, makeup, stains, marks, odor, damage, alteration, stretching, or missing tags or labels.
15. Wrong, damaged or defective products
If you receive the wrong item, or an item arrives damaged, defective or materially different from what you ordered, please contact us as soon as reasonably possible with your order number and clear photographs. We will review the issue and provide the remedy required by applicable law and the circumstances, at no delivery cost to you where the problem was caused by us. This is separate from an ordinary size or preference exchange.
16. Product care
Please follow the care instructions supplied with the product. Damage caused by incorrect washing, drying, ironing, storage, misuse, alteration or ordinary wear is not a manufacturing defect.
17. Intellectual property
The ELLEVATE name, branding, website design, text, photographs, graphics and other content on the website belong to or are licensed to ELLEVATE unless stated otherwise. You may use the website for personal shopping. You may not copy, reproduce, scrape, republish, sell or use ELLEVATE content for commercial purposes without permission.
18. Reviews and other content
If you submit a review, photograph or other content, you confirm that you have the right to submit it and that it is truthful and does not violate anyone else's rights. You allow ELLEVATE to display and use it to operate, improve and promote the store, subject to applicable law and our Privacy Policy. We may remove content that is abusive, misleading, unlawful, fraudulent, unrelated to the product or otherwise inappropriate. Review rewards remain subject to the current Rewards rules and verified purchase requirements.
19. Prohibited use
You must not use the website to commit fraud, interfere with security, attempt unauthorized access, introduce malicious software, scrape or overload the service, abuse discounts, create false reviews, impersonate another person or break the law.
20. Third party services and website availability
Some functions depend on third party services such as payment, delivery, hosting and email providers. We are not responsible for outages entirely outside our reasonable control, but we will take reasonable steps to help where a service issue affects an order. We work to keep the website available and accurate but cannot guarantee uninterrupted access, and we may update, maintain or temporarily restrict parts of it when reasonably necessary.
21. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. To the fullest extent permitted by law, ELLEVATE is not responsible for indirect or consequential losses that were not reasonably foreseeable when the order was placed, or for losses caused solely by circumstances outside our reasonable control. Our responsibility for a product does not affect any mandatory consumer rights that apply to it.
22. Responsibility for misuse
To the extent permitted by law, you are responsible for losses or claims caused by your unlawful misuse of the website, fraud, infringement of another person's rights or deliberate breach of these Terms.
23. Governing law
These Terms are governed by the laws applicable to ELLEVATE's operations in Palestine, subject to any mandatory consumer protections that cannot lawfully be excluded. Please raise any dispute with us first so we have a fair chance to resolve it. Nothing in this section removes any right to bring a claim before a court or authority with mandatory jurisdiction.
24. General
If part of these Terms is found invalid or unenforceable, the rest continues to apply as far as the law allows. If we do not enforce a provision immediately, we do not waive the right to enforce it later.
We may update these Terms when our services, business practices or legal requirements change. The version in effect when an order is placed governs that order, except where a later change is required by law.
